本公司及本平台之本質為一項創新的資訊技術撮合系統、品牌及空間美學顧問商。本平台與平台上的理療師之間不存在任何形式的僱傭、勞資、勞雇或實質代理關係。所有理療師均為「獨立承攬人（Independent Contractor）」，享有完全自主的接單自由、服務時間支配權。理療師並非本公司的員工，本公司概不承擔任何僱主責任。
本平台實行極端的「三方私隱防禦機制」。為了保障閣下的社會聲譽、資產安全以及獨立療癒師的職業安全，本平台全面禁止並限制服務接受者（貴賓）與服務提供者（獨立療癒師）在平台官方 SOP 流程之外交換、索取或儲存彼此的任何個人私隱（包括但不限於：真實姓名、個人電話、WhatsApp、微信、通訊軟體或任何社交媒體賬號）。任何私下越界聯絡或建立非平台撮合之交易行為，均屬於嚴重違約。
本平台定位為全港頂級五星級客房上門服務撮合商。用戶明確知悉，提交 Booking 申請前必須通過平台的《尊尚貴賓資格與私隱安全測評》。平台有權要求用戶提供基本信用背書（包括但不限於：五星級酒店即時入住房號驗證、商務名片或企業郵箱驗證）。本平台保留全權決定拒絕任何未通過審查、具備潛在糾紛風險之用戶預約的權利。
本平台堅守合法、健康、五星級奢華之私人療癒原則。用戶明確知悉，嚴禁向獨立理療師提出任何超出平台規範之非法、不當、不尊重、帶有色情或性擦邊性質的要求。在深度理療過程中，人體因完全放鬆產生的自然生理反應，應視為醫學與芳療範疇之正常現象，並遵循療癒師的專業引導。嚴禁將生理反應轉化為挑逗、騷擾或非分要求。如用戶違反此規定，獨立理療師與本平台有權立即終止服務並離開現場，用戶所支付之所有預約費用與押金將作為違約金全額沒收，本平台並保留法律追訴權。
本平台為提升空間美學體驗，在「The Cozy Collection」頁面中引入全港頂級高奢酒店（如 Rosewood, The Murray, St. Regis 等）的建築與空間介紹，並提供前往第三方營運商（如 Trip.com）之客房預訂外鏈。用戶明確知悉並同意，該等外鏈僅供方便參考，本公司與該第三方營運商不存在任何聯營或法律授權關係。用戶在第三方平台進行的任何酒店預訂、信用卡交易或糾紛，概與本平台無涉。
本平台僅向客戶收取固定比例之資訊技術撮合與品牌使用費。其餘之服務費用及由客戶自願支付之全額小費（Tips 100%），均屬於獨立理療師個人勞務所得之合法報酬，本平台絕不進行任何形式的抽成或扣留。
Welcome to Cozy Spa HK (domain: cozyspahk.com). This Platform is operated and managed by Cozy Infinity Limited (hereinafter referred to as “the Company”). Please read these Terms of Service carefully before browsing this site, making a booking, or submitting any talent screening applications as an independent partner (Advanced Therapist). By continuing to use the Platform, you are deemed to have fully understood and unconditionally accepted to be bound by all the terms of this Agreement.
Important Supplementary Notice: These Terms of Service are intended to govern the general use of the Platform. In the event of any discrepancy, conflict, or omission between these Terms of Service and the “Legal Compliance & Disclaimer” published on this Platform, the latest version of the “Legal Compliance & Disclaimer” shall strictly prevail as the highest legal authority and the ultimate basis for compliance.
The Company and the Platform operate strictly as an innovative information technology matchmaking system, brand essence, and spatial aesthetics consultant. No employment, labor-management, or principal-agent relationship exists between the Company, the Platform, and the therapists. All therapists operate strictly as “Independent Contractors” and maintain absolute autonomy over their booking acceptance, working hours, and execution. Therapists are not employees of the Company, and the Company expressly disclaims any and all employer-related liabilities.
The Platform enforces a strict “Tri-Party Privacy Defensive Mechanism.” To safeguard your social reputation, financial security, and the occupational safety of our independent therapists, the Platform strictly prohibits and restricts service recipients (Clients) and service providers (Independent Therapists) from exchanging, soliciting, or storing any personal privacy information outside the official platform SOP (including but not limited to: real names, personal phone numbers, WhatsApp, WeChat, or any social media accounts). Any unauthorized private contact or off-platform transaction constitutes a material breach of this Agreement.
The Platform is positioned exclusively as a premium provider of five-star in-room wellness matchmaking services in Hong Kong. Users explicitly acknowledge and agree that prior to submitting a booking application, they must pass the Platform’s “Premium Guest Qualification & Privacy Safety Assessment.” The Platform reserves the right to require users to provide basic credit verifications (including but not limited to: real-time five-star hotel room number verification, business cards, or corporate email verification). The Platform retains absolute discretion to refuse bookings from any user who fails the vetting process or presents potential dispute risks.
The Platform strictly adheres to the principles of legal, healthy, and five-star luxury private therapeutic wellness. Users explicitly acknowledge and agree that it is strictly prohibited to solicit, demand, or imply any illegal, inappropriate, disrespectful, or sexually suggestive acts from the independent therapists. During deep therapeutic treatments, any natural physiological or physical reactions resulting from complete relaxation shall be regarded strictly as normal phenomena within the scope of medicine and aromatherapy, and users must follow the professional guidance of the therapist. It is strictly forbidden to convert such physical reactions into flirtation, harassment, or improper demands. In the event of any violation by the user, the independent therapist and the Platform retain full autonomy to terminate the service immediately and vacate the premises. All booking fees and deposits paid by the user shall be forfeited in full as liquidated damages, and the Platform reserves all legal rights to pursue further legal actions.
To enhance the spatial aesthetic experience, the Platform introduces architectural and space profiles of top-tier luxury hotels in Hong Kong (such as Rosewood, The Murray, St. Regis, etc.) under “The Cozy Collection” section, and provides external links to third-party operators (such as Trip.com) for room reservations. Users explicitly acknowledge and agree that such external links are provided solely for convenience, and the Company maintains no joint venture, partnership, or legal authorization with such third-party operators. Any hotel reservations, credit card transactions, or disputes incurred by users on third-party platforms shall be entirely independent of the Platform.
The Platform only charges a fixed percentage of information technology matchmaking and brand licensing fees. All remaining service fees, along with 100% of any voluntary gratuities or tips provided by the client, shall belong entirely to the independent therapist as legitimate remuneration for personal services. The Platform shall not subject these earnings to any form of commission or withholding.
